Terms and Conditions

General Terms and Conditions of Exto.org, based in Arnhem.

1.0 Definitions

Exto.org is a trade name of its parent company Asmen VOF, located at Fruithoeve 9, 6846 JG Arnhem.
Exto is an online community where visual artists can create a free website. Exto also offers paid packages, giving the artist more features as described on the package page. These terms apply to both the free sites and the paid package sites.

1.1 Conditions for Service Provision:

The services offered may not be used in violation of the law, public order, or common decency. It is strictly prohibited to display or store material that is illegal. Linking to sites that do not comply with these conditions is also strictly prohibited.

1.2 Violations of Law, Public Order, or Common Decency Include:

  • Unauthorized use of copyrighted material, trademarked content, or any other legally protected content. See also our Notice and Take Down procedure.
  • Material deemed threatening, discriminatory, obscene, or otherwise offensive by Exto.org.
  • Pornographic content.
  • Sites promoting illegal activities or containing illegal content that could damage our servers or other servers on the internet.

1.3 Examples of Prohibited Content and/or Links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites
  • MP3

1.4 Usage Rules:

  • Our servers may not be the source, intermediary, or destination for spam, flames, or mail bombs.
  • Any attempt to attack or destabilize the servers is strictly prohibited.
  • Sub-hosting is not allowed.

1.5 Traffic (Data Usage) Rules:

All accounts are subject to a Fair Use Policy.

1.6 Access:

All services connected to our accounts are only available to individuals directly associated with the account.

1.7 Liability:

Exto.org cannot be held liable for any damages suffered by a customer or third party due to any action or omission by Exto.org or a company engaged by Exto.org. Exto.org is also not liable for damages suffered by third parties due to actions of any Exto.org customer. Therefore, Exto.org is not liable for indirect or consequential damages, including but not limited to business interruption, loss of profit, internet downtime, or the leaking of confidential information.

1.8 Payment:

All payments must be made by automatic direct debit monthly or annually, or by annual bank transfer unless otherwise agreed, in which case a payment term of 4 weeks after the invoice date applies.
If payments are not made on time or if debited amounts are reversed, the account will be blocked until payment is received. If the outstanding amount is not paid within one month, a first reminder will be sent, after two months a second reminder, and after three months a final warning. A final warning will result in account deactivation until payment is made. In case of continued non-payment, the claim will be handed over to a collection agency or the account will be deleted.
All invoice communications are done via email.

Exto only supplies to private artists and therefore does not invoice to companies.

1.9 30-Day Money-Back Guarantee:

An extra package can be canceled within 30 days after activation. After these 30 days, the cancellation period stated in point 2.0 applies. This rule does not apply to packages with a personal domain name, as these are customized.

2.0 Contract Term, Automatic Renewal:

The package agreement is entered into for a period of 1 year and can be canceled monthly after the first year. No refunds will be issued for mid-term termination.
Cancellations must be made at least 1 month before automatic renewal. Cancellation of domain names and/or hosting accounts must be done via email to admin@exto.org. Exto.org always sends an email confirmation of the cancellation.
For agreements paid by direct debit, a notice period of a full calendar month applies, even within the first year.
A domain name can be changed free of charge after one year. For interim changes, an administration fee of EUR 10 will be charged.
Exto reserves the right to adjust package prices annually based on indexation.

2.1 Refusal and Measures:

  • We reserve the right to refuse or discontinue service if deemed necessary.
  • The account of anyone violating these terms may be terminated immediately.
  • In case of any violation, the account will be terminated without any form of compensation.
  • We reserve the right to establish additional rules for the use of our services.

3.0 Email and Newsletters

Exto.org reserves the right to send emails to registered artists, such as newsletters and service notifications. You can unsubscribe from newsletters at any time, but not from service notifications.

All our agreements are subject to the above terms and conditions unless explicitly agreed otherwise.

Exto.org reserves the right to amend these terms and conditions.
